December 2, 2011 - Here is a new case of potential pure comparative negligence in California. According to reports a woman was struck and killed in Anaheim, while trying to catch a bus. According to Anaheim Police Sgt. Bob Dunn the Anaheim Police Department received reports of a traffic accident prior to 6:00 a.m.
The woman that was struck was found by Anaheim police in the westbound lanes of Katella Boulevard in the vicinity of Harbor Boulevard intersection. The Orange County Coroner’s Office has identified the woman as Denley Angeles age 18.
Angeles was transported to the UCI Medical Center in Orange, where she died at approximately 8:00 a.m. after being struck by a Toyota Camry. The driver of the Camry remained at the scene of the crash and spoke with police, Sgt. Dunn said.
According to Sgt. Dunn, police believe that Angeles had gotten off of a bus and was attempting to cross the street to catch another bus at the time she was struck. The driver was not cited and Anaheim police are investigating whether the driver or Angeles had the right of way. In all events, drivers of vehicles have a duty to look out for pedestrians, even if the pedestrian did not have the right of way.
